If you do not agree to these terms, you may not use the Service. Clarity Property Care reserves the right to modify these terms at any time. Your continued use of the Service following any changes constitutes your acceptance of the new terms.

2. Description of Service

Clarity Property Care provides a diagnostic-first cleaning service platform designed to help property managers address turnover delays, maintenance inconsistencies, and cleaning-related property challenges. Our services include targeted cleaning protocols, diagnostic assessments, real-world problem-solving consultation, and integrated scheduling tools. The platform is intended for use by property managers, property owners, and authorized facility coordinators operating in Italy and surrounding regions.

3. Permitted Use

You agree to use the Clarity Property Care Service only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Service. Prohibited behavior includes:

• Harassing, threatening, or defaming any person or entity
• Uploading or transmitting viruses, malware, or any code of a destructive nature
• Attempting to gain unauthorized access to the Service or related systems
• Reverse-engineering, decompiling, or attempting to derive the source code of any proprietary tools or protocols
• Reproducing, duplicating, or copying content for commercial purposes without written permission
• Submitting false or misleading information about properties or cleaning conditions
• Using the Service to compete directly with Clarity Property Care or to solicit our clients for competing services

4. Intellectual Property Rights

All content on the Clarity Property Care website and platform—including but not limited to text, graphics, logos, diagnostic flowcharts, troubleshooting guides, service protocols, inspection checklists, and software—is the exclusive property of Clarity Property Care or its content suppliers and is protected by Italian and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial property management purposes. You may not reproduce, distribute, modify, adapt, translate, or create derivative works from any content without prior written consent from Clarity Property Care.

Any downloadable materials, including troubleshooting guides and decision trees, are provided for your internal use only and remain the intellectual property of Clarity Property Care.

5. User-Submitted Content

When you submit property photographs, cleaning reports, inspection notes, or other information through the Clarity Property Care platform, you retain ownership of that content. However, you grant Clarity Property Care a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display such content for the purpose of delivering and improving the Service, including for training, quality assurance, and case study development (with anonymization where appropriate).

You represent and warrant that any content you submit is accurate, does not infringe third-party rights, and complies with all applicable laws and regulations.

6. Disclaimers

The Clarity Property Care Service is provided on an "as-is" and "as-available" basis. While we strive to deliver accurate diagnostic assessments and effective cleaning solutions, we make no warranty that:

• The Service will be uninterrupted, error-free, or free from viruses or harmful components
• Any specific cleaning outcome or timeline will be achieved in all circumstances
• The Service will meet your specific expectations or requirements
• Third-party service providers or subcontractors will perform to your satisfaction

Clarity Property Care does not warrant the accuracy of property condition assessments, stain identification, or predicted turnaround times in all cases. Results depend on property-specific factors, material composition, damage severity, and adherence to recommended protocols. We provide diagnostic guidance and targeted solutions based on industry best practices, but outcomes may vary.

7. Limitation of Liability

To the maximum extent permitted by Italian law, Clarity Property Care shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of revenue, loss of profit, loss of business opportunity, or reputational harm, even if Clarity Property Care has been advised of the possibility of such damages.

Clarity Property Care's total liability for any claim arising from or related to the Service shall not exceed the amount you have paid to Clarity Property Care in the twelve months preceding the claim, or fifty euros (€50), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If such limitations are found to be unenforceable in your location, liability shall be limited to the greatest extent permitted by applicable law.

The Clarity Property Care website and platform may contain links to third-party websites, tools, or service providers. We do not endorse, control, or assume responsibility for the content, accuracy, or practices of these external sites. Your use of third-party services is governed by their own terms and privacy policies. Clarity Property Care is not liable for any loss or damage resulting from your interaction with linked third parties.

9. Confidentiality and Data Protection

Information you provide through the Service, including property details, cleaning histories, and contact information, will be treated in accordance with our Privacy Policy. Clarity Property Care commits to protecting your information in compliance with Italian data protection regulations and the General Data Protection Regulation (GDPR).

10. Termination of Access

Clarity Property Care reserves the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if you violate these Terms of Service or engage in conduct that Clarity Property Care deems harmful to the Service, other users, or our business interests.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination—including Intellectual Property Rights, Limitation of Liability, and Governing Law—shall remain in effect.

12. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Italy, without regard to its conflict of law principles. Any legal action or proceeding arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Lombardy, Italy, specifically in the province where Clarity Property Care is registered (Cesano Boscone, Milan).

By using the Service, you consent to the personal jurisdiction of these courts and waive any objection to venue or inconvenient forum.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Clarity Property Care regarding your use of the Service and supersede all prior negotiations, understandings, and agreements, whether written or oral.
